În rechizitoriul întocmit, procurorii au reținut următoarea stare de fapt:
În contextul realizării unui proiect finanțat din fonduri nerambursabile (europene și de la bugetul de stat), denumit „Egalitate pe piața muncii – Proiect pilot pentru sprijinirea persoanelor vulnerabile”, în cursul anului 2014, între beneficiarul proiectului (Agenția Națională Antidrog) și Arhiepiscopia Tomisului Constanța a fost semnat un acord în baza căruia aceasta din urmă trebuia să desfășoare cursuri de formare profesională (operator introducere, validare, prelucrare date – calificare; îngrijire bătrâni la domiciliu; patiser – cofetar) cu un număr de 230 de persoane vulnerabile.
Responsabilul tehnic pentru implementarea proiectului din partea Arhiepiscopiei Tomisului a fost inculpatul Rusnac Vasile.
În scopul atingerii obiectivului prevăzut în acord, Arhiepiscopia Tomisului a externalizat o parte din cursurile de formare profesională, în meseria de patiser-cofetar, către societatea administrată de inculpatul Băcilă Ionuț-Cosmin.
În acest context, în perioada august – octombrie 2015, cei doi inculpați au folosit, cu rea credință, în cadrul proiectului menționat, declarații și documente false, inexacte sau incomplete prin care se atesta în mod nereal realizarea activităților contractate în proporție de 100%, deși în realitate, cursurile de pregătire practică, componentă majoră a cursurilor de formare profesională pentru meseriile de patiser – cofetar, nu avuseseră loc în fapt, aspecte pe care cei doi inculpați le cunoșteau.
Ca urmare a acestor demersuri, inculpații Rusnac Vasile și Băcilă Ionuț-Cosmin au obținut pe nedrept fonduri din bugetul general al Uniunii Europene, în sumă totală de 472.543lei (din care 346.903 lei – Arhiepiscopia Tomisului și 125.640 lei – societatea comercială administrată de inculpatul Băcilă Ionuț-Cosmin).
Organismul Intermediar Regional pentru Programul Operațional Sectorial pentru Dezvoltarea Resurselor umane Regiunea București Ilfov din cadrul Ministerului Fondurilor Europene a menționat că se va constitui parte civilă în cauză, fără însă a preciza cu ce sumă.
Procurorii anticorupție au dispus luarea măsurilor asiguratorii constând în poprirea conturilor bancare deținute de inculpatul Rusnac Vasile și persoana/partea responsabilă civilmente Arhiepiscopia Tomisului, precum și a conturilor bancare deținute de inculpatul Băcilă Ionuț-Cosmin și societatea pe care o administrează, până la concurența prejudiciului.
